中文摘要：由于存在法律術語空缺的情況，《民法典》中的一些法律術語很難在英美法律體系中找到對等的法律術語。此時，正確使用歸化和異化可以更好地實現法律術語翻譯的對等，并為法律文化的交流架起一座橋梁。通過對《中華人民共和國民法典》的兩種英文譯本的比較分析，可以發現譯者在面對法律術語不一致的困境時，還是會盡可能多地采用歸化法，在翻譯中將其回譯為英美法律體系具有類似法律概念的術語。但如果歸化不能更好地還原術語的法律含義時，翻譯人員通常使用異化這一翻譯策略來輸出法律詞匯中的中國特色法律內涵，如采用釋義和創造新詞等翻譯方法。
